You can download printed sheets and use them to record incidents. They should be completed as soon as possible after the incident. They should only contain things, which you have seen or heard.

 
 

Where can I get the incident diary sheets from?

You could save this to your computer and add to it when need or maybe print one off and write down when the anti-social behaviour occurs.

What are they used for?

They are used by the Housing Officer to decidewhat action is required. They are used to prove a pattern of behaviour by the perpetrator(s).

They are used to prepare legal notices to end a tenancy.

They are used as evidence in court cases such as Injunctions, Possession Orders and Anti-Social Behaviour Orders (ASBOs).

What must I remember?

It is very important that you remember to record every incident, you are providing evidence!

It is essential that you remember to sign the statement of truth on the bottom of each diary sheet. You are signing to say that the entries, which you have made, are true.

Remember that your diary sheets may be examined by a Judge so it is important to make sure that your entries are accurate with dates and days and timings of incidents etc relating to each other. For example if you enter Monday the 12th January, make sure that the 12th January is actually a Monday and not a Sunday.

Remember that if a diary sheet is sitting in your drawer at home it is not being used to take action to stop the nuisance!

Remember to take a copy of your diary sheet(s) before sending or giving them to an appropriate officer. If you cannot copy them yourself ask for a copy for your records.

Remember to ask for a receipt for your diary sheets if you want to make sure that the appropriate officer has received them.

Remember if you don’t take the trouble to complete diary sheets the trouble probably won’t stop!

What shall I do with the completed diary sheet?

You do not have to wait until the whole diary sheet is completed. You might want to return it after only one or two entries. This is perfectly acceptable but please continue to record any further incidents on new diary sheets.

If you are a council tenant complaining about the nuisance caused by another council tenant or their family or visitors you should send your completed diary sheets to your local Housing Office.

If you are a council tenant complaining about the nuisance from a private tenant or owner occupier or their family or visitors, you should send your completed diary sheets to the Anti-Social Behaviour Team at the Council House Freeth Street, Oldbury, B69 3DQ.

If you are an owner-occupier or private tenant complaining about the nuisance from a council tenant or their family or visitors, you should send your completed diary sheets to the Local Housing Office. (If you do not know where the Housing
Office is the ASB Helpline 0845 359 7500 will be able to give you the address).

If you are an owner occupier or a private tenant complaining about the nuisance from an owner occupier or private tenant or their family or visitors you should send your completed diary sheet to the Anti-Social Behaviour Team at the Council House
Freeth Street, Oldbury, B69 3DQ.

What happens to them when I have returned them?

They will be used to provide evidence for warning letters to be sent, or legal action to be started.

They will be used to help to prepare witness statements for use in court.

Diary sheets are confidential and the information on them will not be divulged to the perpetrators unless they are used in court. They will not be used in court without your permission.

How many must I complete?

There is no minimum or maximum amount.
 
You must complete diary sheets for as long as the nuisance continues, especially if legal action starts, as it is very  important to prove to the court that the nuisance is ongoing.

It is very unlikely that any action will be taken over one isolated incident unless that incident involves actual harm or a serious threat of harm.
