Dog Control Orders

 

Following extensive public consultation, Sandwell MBC have now introduced Dog Control Orders under Section 55 of the Clean Neighbourhoods and Environment Act 2005.

Dog Control Orders replace the previous system of byelaws for the control of dogs and repeal both byelaws and designations under the Dog (Fouling Land) Act 1996.

The following orders have been made and come into effect as of the 1st January 2008:

  • Fouling of Land by Dogs Order
  • The Dogs on Lead by Direction Order
  • The Dog Exclusion Order

Penalties

Under Section 59 of the Clean Neighbourhoods and Environment Act 2005 an authorised officer of the Council who has reason to believe that a person has committed an offence may give that person a notice offering him the opportunity of discharging any liability to conviction for the offence by payment of a fixed penalty in the sum of £75.

Failure to discharge a liability for a fixed penalty notice within 14 days of issue will result in a prosecution at court.

There is no provision for part payment or payment by instalments.

A person guilty of any such offence will be liable on summary conviction to a fine not exceeding level 3 on the standard scale (currently £1000).

The orders will be available for inspection and copies may be obtained between the hours of 8.30 am to 5.00 pm Monday to Friday, in the Reception Area of the Council House, Freeth Street, Oldbury, B69 3DF.
