Maintenance of Public Rights of Way
An understanding for Maintenance of Public Rights of Way
Any footpath or bridleway in existence between 16th December 1949 and 1st January 1960 is publicly maintainable highway by virtue of Section 47 of the National Parks and Access to the Countryside Act 1947. However, some PROWs may not have a liability in terms of maintaining the highway. In exceptional cases there still may be a private maintenance liability.
